224 - A Framework for Causation in Medicolegal Matters

Understanding and rationally determining causation is rarely as straightforward as medicolegal systems demand. Bias, 'expert' opinion, junk (or no) science, and obfuscation are rampant in the most causation analysis as currently conducted. We propose a biopsychosocial framework for causation analysis - comprising nine discrete but interactive elements - to guide the examiner in analyzing complex medicolegal matters and accurately characterizing any relationship between cause (e.g., industrial or nonindustrial injury or tort) and effect (medical or behavioral health condition). Through lecture, discussion, and real-world examples demonstrating application of the model and relevant legal applications, we help attendees navigate the medicolegal landscapes in which they work. In this more comprehensive and nuanced approach, we present a practical and effective framework for occupational health practitioners, enhancing their ability to make informed and assessments of causation.
